ENGAGEMENT AGREEMENT & PROJECT TERMS

Please read this page and your project quote before paying. By paying the 25% deposit after receiving both, you confirm that you have read, understood and accepted this version dated 5 August 2026, enter into a binding project agreement with BBVF, and authorise BBVF to allocate design resources, schedule the project and reserve a build slot. No signature is required on this viewing page. Please do not pay until anything unclear has been explained. Payment does not limit rights that cannot lawfully be excluded, including under the Australian Consumer Law.

1. PURPOSE + PARTIES

Byron Bay Van Fitouts Pty Ltd (BBVF), ABN 54 677 625 802, based in the Byron Bay region of New South Wales, provides the custom van or motorhome fit-out for the client identified in the quote or invoice. These terms set shared expectations for a smooth, collaborative build and a high-quality fit-out suited to the client's lifestyle and objectives.

2. SCOPE OF WORK

BBVF provides design services, including drawings, layout development and material selections, plus construction and installation of cabinetry, electrical, plumbing and the inclusions listed in the project documents. Mechanical work, engineering certification, bodywork, upholstery, paint and third-party services are excluded unless stated in writing. If BBVF assists with a third-party service, that agreement remains between the client and the provider.

3. CLIENT RESPONSIBILITIES

The client will provide timely decisions, approvals, payments and information; supply the vehicle on the agreed date; maintain comprehensive vehicle insurance while it is at BBVF (unless the vehicle is new and delivered directly by the dealer); and approve requested variations in writing.

4. PRICING, GST + QUOTE VALIDITY

Initial quotes are estimates, not final prices. Pricing may vary slightly once the final design, selections, material availability and specifications are confirmed; adjustments will be discussed transparently and confirmed in writing before commencement. Quotes are valid for 30 days. If the project has not commenced or the deposit has not been paid within that period, supplier, market or scheduling changes may require updated pricing, which BBVF will communicate and confirm before proceeding.

No price increase or changed scope proceeds without written approval. Additional work and variations are charged at $165 per hour including GST ($150 plus GST) for BBVF labour and subcontractors engaged through BBVF. Consumer quotes and invoices will display the total price payable including GST; any GST-exclusive component will not be more prominent than that total.

5. PAYMENT PLAN

The staged payments are 25% deposit to secure the build slot and commence design and scheduling; 50% once designs are approved and material procurement begins; and 25% at the halfway point of the build. The quote or invoice states the GST-inclusive project price and deposit amount. Invoices are payable within 7 days.

If a client-caused payment delay affects scheduling or workshop space, BBVF may pause the project after written notice and a reasonable opportunity to remedy the delay. A restart fee of $1,650 including GST and storage of $550 per week including GST may apply only to reasonable costs caused by that delay, not to delay caused by BBVF or matters outside the client's reasonable control.

6. VARIATIONS + DESIGN REVISIONS

Three full design revisions are included at no charge. Additional changes or redraws are billed at $165 per hour including GST ($150 plus GST), plus a $275 administration fee including GST ($250 plus GST). During design, inclusions may be adjusted against the most recent initial quote without penalty unless a request is materially outside the original scope, in which case variation costs may apply.

No variation proceeds without written confirmation of its work, GST-inclusive price or calculation method and timing impact. The client is not charged to correct a BBVF error or bring work into line with the agreed scope or applicable consumer guarantees.

7. COMMUNICATION

WhatsApp is used for general communication, updates, progress photos and preference clarification. Small clarifications or preference notes may be implemented at no charge where they do not materially affect cost or scheduling. Changes affecting cost, timeline or design will be formally documented and approved in writing.

8. FINAL QUOTE + DESIGN CONFIRMATION

The final detailed quote, itemisation and completed design package are completed after the 25% deposit is paid, before project commencement and only once the client is fully satisfied with the design and inclusions.

9. CHANGE OF MIND + CANCELLATION

The deposit secures the booking slot and authorises design, scheduling and project preparation. For a genuine change-of-mind cancellation, it is non-refundable only to the extent permitted by law and reasonably reflecting completed design work, properly incurred and unrecoverable commitments, and reasonable booking-slot loss BBVF could not reasonably mitigate. BBVF will credit all payments, avoid duplicate recovery, provide an itemised reconciliation and refund any excess.

After design finalisation (meaning written client approval of the completed design package and final detailed quote), the client may also be responsible for reasonable, properly incurred and unrecoverable costs capped at a further 25% of the current GST-inclusive project price. This does not apply where cancellation results from BBVF's breach, an Australian Consumer Law failure or a legally required refund.

10. WARRANTY + CONSUMER LAW

BBVF provides a 12-month craftsmanship warranty from handover. To make a claim, use our website contact form, describe the issue and arrange assessment. If covered, BBVF will repair the craftsmanship at its workshop. The client ordinarily returns the vehicle; BBVF bears or reimburses reasonable claim expenses where the law requires. Normal wear, misuse, modifications, environmental damage and items supplied directly by independent third parties are excluded from this voluntary warranty.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.

If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

11. PHOTOS, MEDIA + CONFIDENTIALITY

BBVF may photograph the completed project for portfolio and social media purposes unless the client opts out in writing. Other project information remains confidential except where disclosure is reasonably needed to deliver the project or is required by law.

12. DISPUTE RESOLUTION

A party raising a dispute should give written notice describing it. The other party will respond within 10 business days, and both parties will discuss it openly and seek a fair resolution in good faith. If unresolved, either party may request assistance through NSW Fair Trading or NCAT. This process does not restrict statutory rights or urgent relief.

13. AGREEMENT VERSION

The version supplied with the quote or deposit invoice and in force when the deposit is paid governs the project. A later website update does not change an existing agreement unless BBVF and the client agree to the change in writing.

14. GOVERNING LAW

This agreement is governed by the laws of New South Wales, Australia, subject to the Australian Consumer Law and other mandatory protections.

PROJECT PRICE, PAYMENT + PROGRAMME

The GST-inclusive project estimate, GST component, deposit amount and payment instructions are stated in the BBVF quote or invoice issued through Xero. Estimated timelines and milestones are confirmed following design approval.
